It used to be that anybody, from any country to get married to a naturalized citizen of the United States and receive their green card quickly.  It seems as though this is something that is becoming a thing of the past, however, as immigration laws are changing on almost a daily basis.  The same is true with the fiance visa application.  In order for someone to become a naturalized citizen of the United States, even if they are married to a citizen of the United States, it is necessary to prove that their marriage is not a sham.

There are two main things that you will need to prove about your marriage in order to file for fiance visa application.  The first is that your marriage is actually legally recognized in the United States.  If you are married within the United States, your marriage must be recognized by the state in which your marriage was performed.  If you are married in another country, your marriage must be recognized legally by the country in which you are married.  If either of these cases was true, then you could file for fiance visa application because your marriage would also be recognized by the United States government.

Another thing that is important in a marriage in order to file for a fiance visa application is that you are not solely united in matrimony for the purpose of obtaining citizenship.  In order for this to be held up in a court of law, you are going to need to furnish proof that your marriage is in fact for the proper purposes.  This can be difficult, but as long as you keep careful records starting at the time even before you are married it should not be difficult to be able to prove that you were in fact married because you are in love.

A fiance visa application also needs to be filed through the proper channels.  In order to find out what these channels are, generally you, your family or an employer, you may need to talk to an immigration attorney.  Even though immigration attorneys can be quite expensive, sometimes you can get free legal advice to the court system that will help to guide you in the proper direction.  Before filing a fiance visa application, you will also need to make sure that is filled out properly and that it ends up going to the proper person.  It would be easy for your application to get kicked back to you if they were improperly filled out or directed.

Even though it is more difficult now than it was 10 or 20 years ago to file a fiance visa application, it certainly is not impossible.  Depending on your circumstances and the amount of time that you've lived in the United States, they could actually go rather quickly and you could end up being a naturalized citizen within a short period of time.
