Being from another country and living in the United States is a difficult thing at times.  Even though there are laws that will generally protect those who are actually lawful permanent residents, there are also some fears that many immigrants worry about.  Anybody that has come to the United States in order to find a better life does not want to get returned to their country of origin.  Some people even go about marrying someone within the United States in order to become a legal citizen.  If this is the case, it is often necessary to file a spouse petition in order for everything to be legal.

There are some regulations in order for somebody that marries a citizen of the United States to become a legal citizen themselves.  It is necessary for you, as the United States citizen, to be able to support your new spouse and any children at a minimum of the poverty level.  If you're immigrant spouse married you before you were a citizen of the United States, it may be necessary for you to apply for immigration petition yourself.  You can simply file a spouse petition in order to receive an immigrant visa number and you will receive this fairly quickly.

Here are some of the immigration laws that will help you to go through the spouse petition process.  In the first place, an immigration petition has to be filled out and filed by either you, a member of your family or a legal employer.  This is the point in which the US Department of immigration will give you your visa number.  Even if you already live in the United States, you have to have this number.

Something that is interesting, and somewhat controversial, is the fact that in order for a spouse petition to be legally submitted and accepted, you must be in a marriage that is not based on the necessity of getting immigration benefits.  If you are in a situation where one of you is not a naturalized citizen of the United States, you must document every aspect of your marriage so that you have evidence that your marriage is not simply for immigration purposes.  If it is decided that you are filing a spouse petition but you are married solely for the purpose of obtaining legal citizenship for you or your spouse, both of you could be penalized in one way or another.

Another thing that is necessary is for your marriage to be valid within the United States.  Any marriage must be recognized within the state in which it was performed.  You can also be married in another country and be legally recognized by the United States as being married, provided you have that same recognition in the country what you were married.  One of the best things to do if you are seeking to file a spouse petition, however, is to speak to an attorney who understands all of the ins and outs of becoming a naturalized citizen.
